1. Acceptance of Terms
By downloading, installing, or using HomeTally ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.
2. Description of Service
HomeTally is a home inventory application for iOS that enables users to catalog, value, and document their belongings. The app provides depreciation tracking, risk assessment, and insurance report generation. All core processing occurs on your device.
3. User Accounts
HomeTally does not require account creation. The app functions entirely on your device without user accounts, logins, or registration. Your Apple ID is used only for managing in-app purchases and optional iCloud Sync.
4. Subscriptions and Payments
Free Tier
HomeTally offers a free tier that includes limited usage (1 property, 3 rooms, 25 items, 3 tags) with core features including photo capture, depreciation tracking, risk profiles, and milestones.
Premium Subscription
Premium unlocks unlimited usage and additional features. Premium is available as:
- Monthly subscription at $2.99/month
- Annual subscription at $24.99/year
Billing
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your Apple ID account settings
- No refunds are provided for partial subscription periods
Price Changes
We reserve the right to change subscription pricing. If pricing changes, you will be notified in advance and given the opportunity to cancel before the new price takes effect.
5. Acceptable Use
You agree to use HomeTally only for its intended purpose of personal home inventory management. You may not:
- Reverse engineer, decompile, or disassemble the app
- Modify, adapt, or create derivative works based on the app
- Use the app for any unlawful purpose
- Attempt to circumvent subscription restrictions or usage limits
- Redistribute or sublicense the app
6. Intellectual Property
HomeTally and all associated intellectual property, including but not limited to the app design, code, algorithms, icons, graphics, and documentation, are owned by HomeTally and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app in accordance with these Terms.
7. User Data and Privacy
Your use of HomeTally is also governed by our Privacy Policy. All user data is stored locally on your device. We do not collect, access, or store your personal data or inventory information on any external servers.
8. Disclaimers
Valuations and Estimates
HomeTally provides estimated replacement values and depreciation calculations for informational purposes only. These estimates are based on general market data and category-specific algorithms. They are not professional appraisals and should not be relied upon as the sole basis for insurance claims, legal proceedings, or financial decisions. We recommend consulting with a qualified appraiser or insurance professional for official valuations.
Risk Assessments
Risk profiles and scores provided by HomeTally are based on general industry data and are intended for informational and awareness purposes only. They are not a substitute for professional risk assessment, insurance advice, or security consultation.
9. Limitation of Liability
To the maximum extent permitted by law, HomeTally and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data (including inventory data stored on your device)
- Loss of profits or revenue
- Insurance claim outcomes based on app-generated reports or valuations
- Inaccurate valuations, depreciation calculations, or risk assessments
- Any damages resulting from unauthorized access to your device
HomeTally is provided "as is" and "as available" without warranties of any kind, either express or implied.
10. Indemnification
You agree to indemnify and hold harmless HomeTally and its developers from any claims, damages, losses, or expenses arising from your use of the app or violation of these Terms.
11. Third-Party Services
HomeTally integrates with Apple services including StoreKit (for in-app purchases) and optionally CloudKit (for iCloud Sync). Your use of these services is governed by Apple's terms and conditions. We are not responsible for the operation or availability of Apple services.
12. Termination
You may stop using HomeTally at any time by deleting the app from your device. We reserve the right to terminate or suspend access to Premium features if you violate these Terms. Upon termination, your locally stored data remains on your device until you delete the app.
13. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the app after changes constitutes acceptance of the revised Terms. If material changes are made, we will make reasonable efforts to notify users through the app or this website.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
